What is the
Specified Companies Agreement?
Under the general agreements which direct the operation of the
Compensation Scheme (called the Morbidity and
Mortality Agreements) only people who are or
have been employed by a Scheme employer and (with the exception
of MOD personnel) are or have been a member of a Scheme trades
union are formally eligible for consideration under the Scheme.
However, in the mid-1990’s, one of the Scheme employers,
UKAEA, was split up to form a number of companies. A large part
of the original Authority retained the responsibility for the
nuclear licensed sites and thus UKAEA remained a Scheme employer.
However, the new companies (eg. AEA-Technology and Johnson Controls)
were either wholly formed by groups of UKAEA employees having
their employment transferred to these companies under the Transfer
of Undertakings (Protection of Employment) Regulations (also
known as “TUPE”).
The important principle is that these people had previously
had access to the Scheme through their employer and, whilst
they continued to work at a nuclear licensed site and, in many
cases, continued in their duties much as they had under their
previous employment, their employment was being transferred
to another company which was not a Scheme employer.
In order to ensure that these groups of people continued to
have access to the Compensation Scheme, the concept of “Specified
Companies” was developed. The principle here is that,
where a Scheme employer transfers employees to another employer
which carries out work on it’s licensed sites, then the
Scheme employer should “specify” that the new employer
is listed and thus the transferred employees continue to have
access to the Scheme. |

Which Companies are listed?
The Specified Companies Agreement has three schedules appended
to it which define the Scheme employers (Schedule A), the Scheme
trades’ union (Schedule B) and the Specified Companies
(Schedule C). These are attached for information.
Please note that, in some of the listings of Specified Companies,
caveats are attached which limit the application of the Scheme
to the employees of that company. Some also have limitations
relating to dates where certain contracts or other arrangements
expired. |
